These Terms and Conditions (“Terms”) govern your access to and use of the BucksheeKit mobile application and website (the “Platform”).
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
1. Incorporation of Policies
The following policies form part of and are incorporated into these Terms by reference:
Together, these documents form the entire agreement between you and BucksheeKit regarding use of the Platform.
In the event of any inconsistency, these Terms shall prevail unless expressly stated otherwise.
2. About BucksheeKit
BucksheeKit operates an online marketplace platform that enables users to list, buy, and sell second hand military, airsoft, and outdoor equipment.
BucksheeKit acts solely as an intermediary platform provider.
We:
Do not own listed items
Do not buy or sell goods
Do not verify ownership, authenticity, or legality
Do not inspect goods
Do not process payments between users
Do not operate escrow services
Are not a party to transactions between users
All transactions are conducted directly between buyers and sellers at their own risk.
3. Eligibility
To use the Platform, you must:
Be at least 18 years old
Be legally capable of entering into binding contracts
Comply with applicable laws
By using the Platform, you confirm that you meet these requirements.
If you use the Platform on behalf of a business, you confirm that you have authority to bind that business to these Terms.
4. User Accounts
You are responsible for:
Maintaining the confidentiality of account credentials
All activity conducted under your account
Ensuring information provided is accurate and up to date
We reserve the right to suspend or terminate accounts that breach these Terms.
5. Nature of Transactions
BucksheeKit does not process payments between users.
We:
Do not hold funds
Do not provide escrow
Do not guarantee payment or delivery
Users are solely responsible for arranging payment and delivery directly.
BucksheeKit may provide general guidance encouraging secure third party payment methods, such as PayPal Goods and Services. This guidance does not constitute endorsement or guarantee.
BucksheeKit is not liable for:
Non payment
Non delivery
Fraud
Chargebacks
Financial loss
6. Seller Obligations
Sellers must ensure:
Lawful ownership of items
Lawful right to sell
Accurate and truthful listings
Compliance with the Restricted Items Schedule
BucksheeKit does not verify ownership or legality.
Sellers accept full responsibility for items listed.
7. Buyer Obligations
Buyers are responsible for:
Conducting due diligence
Verifying item details
Using secure payment methods
Assessing seller credibility
BucksheeKit does not guarantee item condition, authenticity, legality, or delivery.
8. Featured Listings
BucksheeKit may offer paid promotional services including Featured Listings.
Featured Listings:
Provide increased visibility only
Are time limited
Do not guarantee views, enquiries, or sales
Payment is for promotional placement only.
Featured Listings are subject to the Featured Listings Policy.
9. Fees and Payments to BucksheeKit
Certain features, including promotional services, may require payment.
In app purchases are processed by Apple App Store or Google Play and are subject to their respective terms and refund policies.
Fees for promotional services are non refundable once activated, except in cases of verified technical fault.
10. Prohibited Conduct
Users must not:
Engage in fraudulent activity
Misrepresent items
List prohibited items
Circumvent fees
Harass other users
Attempt to interfere with the Platform’s operation
We reserve the right to remove listings and suspend accounts at our discretion.
11. Content Moderation
BucksheeKit reserves the right to:
Remove listings
Remove user content
Restrict features
Suspend or terminate accounts
Content may be removed where it breaches policies or poses legal or reputational risk.
We are not obliged to provide detailed justification for moderation decisions.
12. Disputes Between Users
BucksheeKit is not responsible for resolving disputes between buyers and sellers.
We may assist at our discretion but are under no obligation to intervene.
13. Intellectual Property
All Platform branding, design, text, and logos are the property of BucksheeKit.
Users grant BucksheeKit a non exclusive licence to display listing content for operational purposes.
14. Limitation of Liability
To the fullest extent permitted by law:
Transactions between users
Fraud or misrepresentation
Non payment or non delivery
Loss of profit
Loss of opportunity
Indirect or consequential loss
BucksheeKit shall not be liable for:
Total aggregate liability arising out of or in connection with use of the Platform shall not exceed the total amount paid by the user to BucksheeKit in the preceding 12 months.
Nothing in these Terms excludes liability which cannot legally be excluded under the laws of England and Wales.
15. Indemnity
Users agree to indemnify and hold harmless BucksheeKit from any claims, losses, damages, liabilities, and costs arising from:
Breach of these Terms
Unlawful listings
Fraudulent activity
Misrepresentation
Violation of applicable laws
16. Suspension and Termination
We may suspend or terminate access where:
These Terms are breached
There is suspected unlawful conduct
Platform integrity is at risk
Users may delete their account at any time.
17. Data Protection
Personal data is processed in accordance with our Privacy Policy and UK GDPR.
18. Updates to Terms
We may amend these Terms and related policies at any time.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
19. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
